2010 Capital Pride Parade Agreement, Rules, and Regulations



These rules and regulations form part of the Application and Agreement for participation in the 2009 Capital Pride Parade (“Parade”) between the Capital Pride Alliance, Inc. d.b.a. Capital Pride (“CPA”), and the Parade Applicant (“Participant”).

1. Participant understands that the 2010 Capital Pride Parade will take place on Saturday, June 12 2010, Parade check-in commences at 4:00 PM; the Parade will commence at 6:00 PM; the “period of the Parade” shall be from 4:00 PM until the conclusion of the Parade; and that all times denoted within this agreement are Eastern Time.

2. Participant understands that a representative of each group must check in by 5:30pm; large floats must be in line by 4:30pm; all other contingents with vehicles by 5:00pm; and all walking contingents by 5:30pm; and that all participants must be in line and ready to start by 6:00 pm.

3. Participants applying for Non-Profit contingent classification must submit certification of non-profit status.

4. All participants must attend an orientation meeting to discuss final assembly and participation regulations, and to receive Parade line-up assignments, assembly time, and assembly instructions (location and time TBA).Participants located outside of the Washington Metropolitan area may make other arrangements to meet this requirement. Please inquire for details.

5. Participant fees for approved Applications are non-refundable. There is no “rain date” should the Parade be canceled or shortened due to inclement weather and no Participant fees are refundable in the event of cancellation due to acts of God, fire, natural disaster, terrorism, war, military hostilities, or any other force majeure events, or cancellation by government agencies.

6. Participants shall comply with and ensure that its employees, agents, representatives, and/or members comply with all legal requirements imposed by the District of Columbia government agencies and/or any other government agencies.

7. To the full extent permitted by law, the CPA shall not in any manner or for any cause be liable or responsible to any Participant or any other for any injury or damage to any person, business, or property in any way related to, or arising in connection with, the Parade. Any and all claims for such injuries or damages are hereby waived and Participant agrees to indemnify and hold harmless the CPA and directors, officers, volunteers, and agents (the “Indemnified Parties”) against any and all claims, liabilities, losses and expenses, including reasonable attorney’s fees, imposed on, incurred by, or asserted against Indemnified Parties caused by any act or omission of Participant, or arising in connection with the activities conducted by the Participant in connection with the Parade.

8. Assignment of placement in the Parade is processed according to many criteria. Assignment of placement is at the sole discretion of the CPA. Should conditions dictate, the CPA reserves the right to reassign placement as necessary.

9. The CPA reserves the right to determine eligibility of any Participant for inclusion in the Parade.

10. Participant shall not utilize any apparatus, device, equipment, or material that shall in any manner be objectionable to other Participants or to spectators, or that shall in any manner be dangerous or calculated to cause injury to any persons coming into contact with them or the residents or property along the Parade route.The CPA has the sole right to determine whether such apparatus, device, equipment, or material are inconsistent with this provision and may require their immediate removal.

11. The CPA reserves the right to prohibit the display of any signage, article, or product that, in its opinion, is not in keeping with the nature and character of the Parade, or not in harmony with other Parade contingents.

12. Participants shall conduct themselves in a professional and courteous manner. No Participant shall operate amplification equipment or voice or audio reproducing equipment that would cause annoyance to other Participants, to spectators of the Parade, to the residents and/or businesses along the Parade route or in excess of allowable levels according to government regulations. The CPA has the sole right to determine whether a Participant is operating in a manner inconsistent with this provision, and has the right to order the immediate cessation of such activity.

13. Participants and contingents are responsible for picking up and cleaning the parade route with their appropriate contingent. Contingents and participants with confetti or items that are thrown from the parade entry shall be monitored by parade officials of Capital Pride and any contingent that does not monitor self clean-up shall incur fines or fees associated with cleanup by the District of Columbia Department of Public Works.

14. In the event that the premises on which the Parade is to be held are destroyed or damaged by the elements or any other cause, so that the Parade cannot be held, Participant shall have no cause of action or claim for damages or compensation against the CPA except for the return of any amount previously paid, and in such an event, this Agreement shall be terminated.

15. Participant shall at Participant’s expense, provide insurance for protection of Participant’s property against fire, theft, vandalism, or destruction by any cause, and provide the CPA with a copy of the policy. The CPA shall in no way be liable for Participant’s failure to obtain proper insurance, and Participant agrees to indemnify and hold harmless the CPA for any such failure to obtain insurance.

16. Participant represents and warrants that the Participant has or will maintain throughout the conclusion of the Parade appropriate insurance policies and coverage limits for all vehicles, property, and individuals participating in the Parade on behalf of the Participant, and that CPA is, or will be, named as an insured under such policies for the period of the Parade. Participant will provide CPA with a copy of such policies upon CPA’s request.

17. Participant shall display and conduct contingent in such a manner as not to cause damage to any other Participant or contingent to the Parade route, or to any property along the Parade route.

18. Participant must make provisions for the safeguarding of goods, materials, equipment, and displays at all times.The CPA shall in no way be liable for Participant’s failure to make provision for the safeguarding of such items, and Participant agrees to indemnify and hold harmless the CPA for any such failure to make such provisions.

19. Failure by Participant to observe these rules and regulations, all applicable government rules and regulations, and any other applicable rules and regulations will result in denial to participate in the Parade, forfeiture of all applicable fees, and may result in reimbursement of government fines and penalties incurred by the CPA.

20. BY PURCHASING A REGISTRATION FOR THE PARTICIPANT, THE INDIVIDUAL DOING SO HEREBY WARRANTS THAT THE INDIVIDUAL IS AN AUTHORIZED AGENT OF THE PARTICIPANT, AND HAS THE AUTHORITY TO BIND THE PARTICIPANT TO THIS AGREEMENT, AND HEREBY ACCEPTS AND AGREES TO ABIDE BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT AND ANY SUBSEQUENT, WRITTEN TERMS, CONDITIONS, AND DIRECTIONS PROVIDED BY CPA, ON BEHALF OF THE PARTICIPANT.
